Name another driver

If you get a fine for an offence that was detected by a camera, and someone else was driving your vehicle at the time, you must name that person as the driver. This is called nominating another driver. If you do not nominate the driver within 21 days, you are committing an offence that has substantial fines.
Once you nominate the driver, the fine may be transferred to the person you nominate. Your nomination may be rejected if you do not provide enough information about the driver.
- If someone else was driving the vehicle at the time of the offence; and
- The offence was camera detected, rather than on-the-spot
You can’t name another driver if:
- You were given the fine in person, or
- The offence is not a camera detected offence
Be quick
You must name the person responsible within 21 days of receiving the penalty notice notice before the due date shown on the fine.
Don’t pay your fine
If you name someone else, don't pay the fine.
If you do not nominate the driver
You will be committing an offence by not nominating the driver. The law will treat you as though you were the driver at the time of the original offence. This means you will have to pay the fine and demerit points or licence suspension from the camera recorded offence will be recorded against your licence.
Making a false nomination
If you falsely nominate another person as the driver, serious penalties apply. This can include a fine of up to $10,000.
You can nominate another driver online – you will need your penalty notice to do this. There is information on your penalty notice about where to go to make the nomination online.
Once Revenue NSW receives your nomination, it will be reviewed. If it is accepted, a new fine will be sent to the driver that you nominated. Your fine will then be cancelled. Revenue NSW may contact you if they need anything else from you.

Your application is reviewed
Revenue NSW will check that your nomination includes all of the necessary details and is provided within the correct time limit.
Re-issue the fine to the driver
A new fine will be sent to the driver. Your fine will be cancelled.
You may be contacted by Revenue NSW
You might need to do a Statutory Declaration confirming your nomination and provide further information that may assist to prove who was the driver at the time of the offence. You might also be required to give this information in person.
This is only likely to happen if the driver you nominate denies they were the driver. Or Revenue NSW is concerned that your nomination might not be correct.
